1. Acceptance of Terms

By accessing or using the Beaufart™ platform ("Service"), including our store, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

Important: Beaufart™ is a parody and entertainment platform. It is not affiliated with any meteorological organizations or the original Beaufort Scale.

2. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you should have parental consent before using this platform. You must be at least 18 to make purchases from our store.

3. User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

• You may not share your account credentials with others
• You must notify us immediately of any unauthorized access
• You may not create multiple accounts for abusive purposes

4. User-Generated Content

You retain ownership of the content you upload to Beaufart™. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the platform.

You represent and warrant that:

• You own or have the rights to upload the content
• The content does not violate any third-party rights
• The content complies with our Community Guidelines

5. Store & Products

All products sold through the Beaufart store are custom printed to order using third-party print-on-demand fulfillment services. By purchasing products you acknowledge:

• Products are manufactured only after your order is placed and paid for
• Colours may vary slightly from what you see on screen due to differences in display calibration and printing processes
• Product images are provided for illustrative purposes — the finished product may differ slightly in appearance
• We reserve the right to change prices at any time; the price applicable to your order is the price displayed at the time of purchase

6. QR Code Products

Some products feature a printed QR code that links to an audio emission on the Beaufart platform. By purchasing a QR code product:

• You acknowledge the QR code links to content hosted on our platform
• We do not guarantee permanent availability of linked content — emissions may be removed if they violate our community guidelines
• The QR code is generated for the specific emission selected at the time of purchase and cannot be changed after printing
• You may only place your own emissions on QR code products unless purchasing via a “Buy Me This” link shared by the emission owner

7. Personalised Items & Cooling-Off Period

Products featuring QR codes linked to specific emissions, and all custom-printed products, are made to your specification. These are therefore exempt from the 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This exemption is confirmed at checkout before you place your order.

8. Payment

We accept payment via credit/debit card, Apple Pay, and Google Pay, processed securely by Stripe. We do not store your full payment card details on our servers. All prices include applicable VAT/sales tax unless otherwise stated.

9. Shipping & Delivery

• Orders are typically dispatched within 2–7 business days of payment, depending on the product and fulfillment provider
• Estimated delivery times are provided at checkout and vary by shipping method and destination
• We are not responsible for delays caused by postal services, customs processing, or events outside our control
• International orders may be subject to local customs duties and import taxes, which are the responsibility of the buyer

10. Returns & Refunds

Please see our full Returns Policy for details. In summary: as all products are custom printed to order, we do not accept returns for change of mind. We will replace or refund items that arrive damaged, defective, or incorrect.

11. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, or discriminatory
• Impersonate others or misrepresent your identity
• Upload content that is not genuine (e.g., fake sound effects presented as real)
• Spam, manipulate votes, or engage in other deceptive practices
• Attempt to circumvent security features or exploit vulnerabilities
• Use automated systems to access the Service without permission
• Harass other users or interfere with their enjoyment of the Service

12. Content Moderation

We reserve the right to remove any content that violates these terms or our Community Guidelines at our sole discretion. We may also suspend or terminate accounts that repeatedly violate our policies.

13. Intellectual Property

• The Beaufart™ brand, logo, and platform design are our intellectual property
• The rating system and scale descriptions are original works created for parody purposes
• Audio emissions uploaded by users remain the intellectual property of the uploader
• You may only place your own emissions on QR code products; placing another user’s emission on a product without their consent is prohibited

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT ON THE PLATFORM.

Beaufart™ is intended for entertainment purposes only. Nothing on this platform should be construed as medical, scientific, or professional advice.

15. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

16. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes by posting a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.
